El objetivo de este trabajo es mostrar lo que las investigaciones realizadas desde el ámbito psicológico señalan sobre cómo se sienten las mujeres que sufren violencia en la pareja e inician un procedimiento judicial, incluso antes de interponer la denuncia. Comenzaremos señalando las dif icultades que para las mujeres conlleva denunciar a quien es o ha sido su pareja afectiva, para seguir con un análisis de lo que esperan conseguir con la denuncia, cómo se sienten tratadas en su contacto con (...) el sistema judicial, cómo viven las primeras respuestas obtenidas, especialmente las que conciernen a las Órdenes de Protección, las emociones y expectativas a lo largo del procedimiento judicial, así como la importancia del acompañamiento y asesoramiento especializado. Para f inalizar, resaltaremos la importancia de la especialización de los y las profesionales que intervienen a lo largo del procedimiento judicial. Con dicho conocimiento sobre los aspectos emocionales y comportamentales de estas mujeres que han sufrido violencia y de los motivos que pueden explicarlos, pretendemos contribuir a una mayor comprensión de las mismas que evite la victimización secundaria y el que las mujeres acaben renunciando por una pérdida de conf ianza en el sistema judicial. This work has two objectives. The first is to begin a mathematical formalism appropriate to treating particles which only interact with each otherindirectly due to hypothesized memory effects in a stochastic medium. More specifically we treat a situation in which a sequence of particles consecutively passes through a region (e.g., a measuring apparatus) in such a way that one particle leaves the region before the next one enters. We want to study a situation in which a particle may interact with (...) other particles that previously passed through the system via disturbances made in the region by these previous particles.Second, we apply the type of stochastic process appearing in this context to the stochastic interpretation of quantum mechanics to obtain a modified version of this interpretation. In prevention and health promotion interventions, screening methods and risk profile assessments are often used as tools for establishing the interventions’ effectiveness, for the selection and determination of the health status of participants. The role these instruments fulfil in the creation of effectiveness and the effects these instruments have themselves remain unexplored. In this paper, we have analysed the role screening methods and risk profile assessments fulfil as part of prevention and health promotion programmes in the selection, enrolment and participation (...) of participants. Our analysis showed, that screening methods and health risk assessments create effects as they objectify health risks and/or the health status of individuals, i.e., they select the individuals ‘at risk’ and indicate the lifestyle modifications these people are required to make in order to improve their health. Yet, these instruments also reduce the group of participants thereby decreasing the possible effect of interventions, as they provide the legitimisation for people to make choices to whether they enrol or not and what lifestyle changes they incorporate into their lives. In other words, they present a space of interaction, in which agency is distributed across the practice nurses, the participants and the instruments. Decisions were not just made upon the projection of the outcomes of these instruments; decisions that were made by both the patients and practice nurses were the resultant of their opinions on these outcomes that were formed in interaction with the instruments. We first show that a theorem by Cartan that generalizes the Frobenius integrability theorem allows us (given certain conditions) to obtain noncurvature solutions for the differential Bianchi conditions and for higher-degree similar relations. We then prove that there is no algorithmic procedure to determine, for a reasonable restricted algebra of functions on spacetime, whether a given connection form satisfies the preceding conditions. A parallel result gives a version of Gödel's first incompleteness theorem within an (axiomatized) theory of gauge fields.

Despite the widespread popularity of the Creating Shared Value discourse, its ‘business case’ and ‘win–win’ rhetoric remain problematic. This paper adds an inclusive development perspective to the debate, arguing that analysing CSV strategies through an inclusivity lens contributes to a better operationalisation of societal value; makes tensions and contradictions between economic and societal value explicit and uncovers processes of inclusion, exclusion and adverse inclusion. We illustrate this by analysing Nestlé’s CSV strategy in its cocoa supply chains in Ghana based on (...) content analysis of company documents, interviews with value chain actors and stakeholders, and focus groups with farmers. We ask how Nestlé frames and implements its CSV discourse in practice and how this relates to the social, relational and environmental dimensions of inclusive development. Findings show how the company addresses inclusive development dimensions in its corporate discourse, practices and business operations, and what trade-offs it faces. We then unmask the inherent tension between business objectives and societal interests and explain why the scope, issues addressed and societal impacts of CSV remain constrained. We conclude that CSV can help reduce a company’s impact on some persistent societal issues, but that its contribution to transformational change remains limited because the need to uphold competitive advantages and short-term financial performance narrows its ability to address all inclusivity dimensions. Legislation mandating responsible business conduct and due diligence can reduce this inherent tension by levelling the playing field between companies addressing inclusivity issues vis-à-vis those who do not. Theorie für nicht möglich hält, vertrete ich die These: Eine umfassende biologische Theorie, ausgehend von den Grundlagen der Physik, ist bis dato nicht ausschließbar.Betrachtet man die Frage ‘In welchem Sinne ist eine umfassende physikalische Theorie heute möglich?’, so ergibt sich, daß die Konzipierung je umfassenderer Theorien mit einer Beschränkung des vorhandenen empirischen Satzbestandes einerseits, mit einer Hinzunahme von Regeln für neue empirische Befunde andererseits verbunden ist. Wie am Beispiel einer Schar verschiedenartiger (...) statistischer Mechaniken gezeigt wird, oder wie der an einem experimentell nicht überprüfbaren Wert postulierte Übergang derGalilei- in dieLorentz-Transformation deutlich macht, stellen aufeinanderfolgende, abgeschlossene physikalische Theorien keineswegs Grenzfälle der vorausgehenden Theorien dar.Das unzureichende quantentheoretische Aufbauprinzip der Produkträume zur Konstituierung biol. Systeme weist ebenso wie die Nichtnachprüfbarkeit der Quantentheorie für makrophysikalische Körper auf einen umfassenderen Ansatz hin. Objectives To evaluate whether the requirement of “minimal risk and burden” for paediatric research without direct benefit to the subjects compromises the ability to obtain data necessary for improving paediatric care. To provide evidence-based reflections on the EU recommendation that allows for a higher level of risk. Design and setting Systematic analysis of the approval/rejection decisions made by the Dutch Central Committee on Research involving Human Subjects (CCMO). Review methods The analysis included 165 proposals for paediatric research without direct benefit (...) that were reviewed by the CCMO between January, 2000, and July, 2007. A separate, in-depth analysis of all drug studies included 18 early phase drug studies and nine other drug studies without direct benefit. Results 11 out of 165 studies were definitively rejected because the CCMO did not regard the risk and/or burden to be minimal. In three of these 11 cases (including two early phase drug studies) the requirement of minimal risk and burden was cited as the only reason for rejection. Four other early phase drug studies also involved risks and/or burdens that were not regarded to be minimal but were nevertheless approved. Conclusions The requirement of minimal risk and burden, aiming to protect research subjects, occasionally leads to rejection of protocols. Early phase drug studies relatively often do not comply with the requirement. Committees may find ways to approve important studies that formally should be rejected, but that is not a desirable solution. The regulatory framework should be revised to make such occasional exceptions to the requirement legitimate and transparent. (shrink)

Health technology assessment (HTA) is often biased in the sense that it neglects relevant perspectives on the technology in question. To incorporate different perspectives in HTA, we should pursue agreement about what are relevant, plausible, and feasible research questions; interactive technology assessment (iTA) might be suitable for this goal. In this way a kind of procedural ethics is established. Currently, ethics too often is focussed on the application of general principles, which leaves a lot of confusion as to what really (...) is the matter in specific cases; in an iTA clashes of values should not be approached by use of such ethics. Instead, casuistry, as a tool used within the framework of iTA, should help to articulate and clarify what is the matter, as to make room for explication and consensus building. (shrink)

Current UK legislation is impacting upon the feasibility and cost-effectiveness of medical record-based research aimed at benefiting the NHS and the public heath. Whereas previous commentators have focused on the Data Protection Act 1998, the Health and Social Care Act 2001 is the key legislation for public health researchers wishing to access medical records without written consent. The Act requires researchers to apply to the Patient Information Advisory Group for permission to access medical records without written permission. We present a (...) case study of the work required to obtain the necessary permissions from PIAG in order to conduct a large scale public health research project. In our experience it took eight months to receive permission to access basic identifying information on individuals registered at general practices, and a decision on whether we could access clinical information in medical records without consent took 18 months. Such delays pose near insurmountable difficulties to grant funded research, and in our case £560 000 of public and charitable money was spent on research staff while a large part of their work was prohibited until the third year of a three year grant. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice.
